Ohio LLC EIN: Who Needs One and How to Apply in 2026
An EIN is a federal tax-identification number issued by the IRS. The IRS does not charge a fee for it. Whether an Ohio LLC is required to have its own EIN depends on the LLC’s owners, tax classification, employees, excise-tax obligations, and other business needs.
2026 EIN facts
- ✓ IRS government fee: $0
- ✓ Form the Ohio LLC before applying for the EIN
- ✓ The IRS online tool can issue an EIN immediately when the application is approved
- ✓ A responsible party with an SSN or ITIN can use the current online tool when the other eligibility rules are met
- ✓ A single-member disregarded LLC with no employees or relevant excise-tax obligation may not need a separate EIN for federal tax purposes
When an Ohio LLC needs or may want an EIN
Do not use the shortcut “every LLC needs an EIN.” The answer depends on the federal tax rules and the business’s actual needs.
The LLC has employees and must report employment taxes
The LLC must file certain federal excise-tax returns
The LLC has two or more members and is generally treated as a partnership unless it elects another eligible classification
The LLC elects or otherwise needs a corporate tax classification requiring its own EIN
A bank, state agency, licensing office, vendor, or other legitimate business purpose requires an EIN even when federal income-tax rules would not
Single-member LLC: the important exception
For federal income-tax purposes, a domestic single-member LLC is generally disregarded as separate from its owner unless it elects another classification. If that LLC has no employees and does not have a relevant excise-tax filing obligation, the IRS says it may use the owner’s taxpayer identification number instead of obtaining a separate LLC EIN for federal income-tax purposes.
The LLC may still request an EIN for banking or state purposes, and it must use its own EIN for employment taxes and certain excise taxes when those rules apply.
Apply after the Ohio entity is formed
The IRS currently tells applicants creating an LLC, partnership, or corporation to register the legal entity with the state before applying for the EIN. Use the legal name exactly as it appears in the approved formation record, subject to the IRS’s business-name formatting rules.
This avoids unnecessary mismatches between Ohio Secretary of State records, IRS records, bank records, and later tax filings.
Who can use the IRS online EIN tool?
Under the current IRS online-tool rules, all of these should be true:
✓ The entity is domestic — formed or created in the United States or U.S. territories
✓ The principal place of business is in the United States or U.S. territories
✓ The applicant is the responsible party or an authorized representative
✓ The responsible party has an SSN or ITIN
✓ The applicant completes the IRS online session and stays within the daily EIN limit
ITIN correction
The older version of this page incorrectly said ITIN holders cannot apply online. The current IRS eligibility page expressly allows the responsible party’s SSN or ITIN, assuming the other online eligibility conditions are satisfied.
Other ways to apply
| Method | Current IRS guidance |
|---|---|
| Online | Free; if approved, EIN issued immediately online |
| Fax Form SS-4 | About 4 business days when a return fax number is provided |
| Mail Form SS-4 | Approximately 4 weeks, subject to processing delays |
Applicants whose principal place of business is outside the United States follow the IRS international-applicant procedures rather than the domestic online tool.
Responsible party
The EIN application identifies the person who ultimately owns or controls the entity or exercises effective control over it. The application generally requires identifying information for that responsible party. A nominee should not be used as the responsible party.
For complex ownership structures, foreign ownership, trusts, or unusual tax classifications, review the current Form SS-4 instructions rather than relying on a generic example.
After the EIN is issued
Save the confirmation
Keep the IRS EIN confirmation with the company’s permanent records.
Expect a short IRS-system delay for some uses
The IRS says an EIN can be used immediately for many business needs, but some IRS matching, e-filing, and electronic-payment systems may take up to about two weeks to recognize a new EIN.
Keep the legal name consistent
Use the same legal entity name across state, IRS, bank, payroll, vendor, and license records where the legal name is required.
Do not request duplicate EINs
A business entity should not keep applying for new EINs simply because the original number or confirmation was misplaced.
Frequently asked questions
How much does an EIN cost from the IRS?+
The IRS charges no government fee for an EIN. Eligible applicants can apply directly through the IRS online EIN tool for free. A private document-preparation provider may charge a separate preparation fee if you choose to use one.
Does every single-member Ohio LLC need its own EIN?+
No. A single-member LLC that is disregarded for federal income-tax purposes, has no employees, and has no relevant excise-tax filing obligation may not need a separate EIN for federal tax purposes. It may still request one for banking or state purposes, and an EIN is required in several other situations.
Should I form the Ohio LLC before applying for the EIN?+
Yes. The IRS currently instructs applicants creating an LLC or corporation to form the legal entity with the state before applying for an EIN. This helps the EIN application match the final legal entity name.
Can a responsible party with an ITIN use the IRS online EIN tool?+
Yes, under the current IRS online-tool eligibility rules, a domestic organization with a U.S. principal place of business may use the online tool when the responsible party has an SSN or ITIN and the other eligibility requirements are met.
How quickly can the IRS issue an EIN?+
The IRS says its online tool can issue the EIN immediately if the application is approved. Fax applications are generally returned in about 4 business days when a return fax number is provided, while mailed Form SS-4 applications are generally processed in about 4 weeks, subject to IRS delays.
Need EIN application information prepared?
The IRS EIN itself is free. Asal Business Solutions can provide private document-preparation help when requested; any private preparation charge is separate from the IRS government fee.
