Do I Need an EIN for My LLC?

An Employer Identification Number (EIN) is the federal tax ID for your business entity. Even when the IRS does not strictly require one, banks and trucking authority filings usually do—which is why nearly every LLC we form in Columbus gets an EIN the same week.

When the IRS requires an EIN

  • LLC with more than one member (multi-member LLC) — generally must file partnership return or elect corporate tax status
  • Any LLC with employees — payroll tax deposits require an EIN
  • LLC taxed as a corporation or S corporation after election
  • Certain excise or pension plan filings

Single-member LLC nuance

A single-member LLC is often a "disregarded entity" for federal tax by default—the IRS may allow using the owner's SSN on Schedule C in some cases. Practically, that exception rarely survives contact with a business bank, a commercial insurance underwriter, or FMCSA registration.

We still obtain an EIN for virtually all single-member LLC clients because downstream paperwork demands it.

What you need an EIN for (even if optional)

  • Opening a business checking account in the LLC's name
  • Applying for USDOT and MC authority under the company
  • Hiring drivers or office staff
  • 1099 and W-2 reporting
  • Business credit and vendor accounts

Trucking owner-operators who try to register authority under a personal SSN while "planning to get an EIN later" lose weeks fixing mismatched FMCSA records.

How to apply (free)

  1. Wait until LLC is acceptedUse the legal name exactly as Ohio Secretary of State approved it.
  2. Identify responsible partyUsually a member or manager with an SSN or ITIN.
  3. Apply online at IRS.govOnline assistant issues the EIN immediately upon success during operating hours.
  4. Save IRS confirmation letterBanks want CP 575 or the online confirmation PDF. Store it with your operating agreement.

EIN vs. Ohio tax accounts

The EIN is federal. Ohio may separately require withholding account numbers, sales tax vendor licenses, or municipal income tax registration depending on activity. Forming the LLC and getting an EIN does not automatically register you for all state and local taxes.

Frequently asked questions

Is an EIN the same as a Social Security Number?
No. EIN identifies a business entity. SSN identifies an individual. Use the EIN for business accounts and federal business tax forms.
Does an EIN cost money?
The IRS does not charge for direct online application. Paid services charge convenience fees.
Can a non-U.S. resident get an EIN for an Ohio LLC?
Yes, but the application path differs—often fax Form SS-4 without an SSN. Plan extra processing time.
Do I need a new EIN if I convert from sole prop to LLC?
Often yes when forming a new legal entity. The IRS publishes rules for successions and conversions—do not assume the old EIN carries over.
How fast can I get an EIN?
Online applications through IRS.gov are immediate when eligible. Mail and fax take weeks.
